Terms of Service

These Terms of Service (“Terms”) govern your access to and use of DataTagLink (the “Service”) — the DataTagLink apps (iOS, Android, and web), the DataTagLink NFC tags we supply, and datataglink.com. By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you agree to these Terms on its behalf and confirm you’re authorised to do so.
The service
DataTagLink links a physical NFC tag to a digital record of an asset — photos, documents, location and activity history, and one-tap ownership transfer. We may add, change, or remove features from time to time.
Accounts
You must provide accurate information and keep your login credentials secure. You’re responsible for activity that happens under your account. New accounts are subject to review and approval, and access may be organised into companies (“tenants”) with different roles. The Service is a business/organisational tool and isn’t intended for children.
Physical tags
We supply DataTagLink NFC tags for use with the Service. Availability, quantities, shipping, and any fees are communicated when you order. Unless stated otherwise, risk in the tags passes to you on delivery. Tags are provided for use with the Service and aren’t sold for resale.
Acceptable use
Don’t use the Service for anything unlawful, infringing, or harmful; don’t attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to it; and don’t upload content you don’t have the right to use or that contains other people’s personal information without a lawful basis.
Your content
You keep ownership of the data, photos, and documents you add. You grant us the limited licence needed to host and process that content solely to provide the Service to you and your organisation. You’re responsible for your content and for having the rights to it. How we handle data is described in ourPrivacy Policy.
Fees and subscriptions
Some plans or features may require payment. Applicable fees, billing cycles, and taxes are shown before you buy. Purchases made through the Apple App Store or Google Play are also subject to that store’s terms. Except where the law requires otherwise, fees are non-refundable.
Intellectual property
The Service, its software, and the DataTagLink name and branding are owned by us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.
Availability
We aim to keep the Service available and reliable, but we don’t guarantee it will be uninterrupted or error-free, and we may suspend it for maintenance or modify or discontinue features.
Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. DataTagLink is a record-keeping tool and isn’t a substitute for your own records or compliance obligations. Nothing in these Terms excludes or limits rights you have that cannot be excluded under applicable law, including the Australian Consumer Law.
Limitation of liability
To the extent permitted by law, we aren’t liable for indirect or consequential loss, or for loss of data or profits, arising from your use of the Service; and our total liability is limited to the amount you paid us for the Service in the twelve months before the claim. This doesn’t limit any liability that can’t be excluded by law.
Termination
You can stop using the Service or close your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination your right to use the Service ends; terms that by their nature should survive will continue to apply.
Changes to these terms
We may update these Terms from time to time. Continued use of the Service after a change takes effect means you accept the updated Terms; for material changes we’ll make reasonable efforts to let you know.
Governing law
These Terms are governed by the laws of Australia, and the courts of Australia have jurisdiction over any dispute, without affecting any mandatory rights under the law of the place you live.
